Your Information
PRIVACY POLICY
DuskSoft Studios
DUSKSOFT STUDIOS LLC, a Wyoming limited liability company doing business as DuskSoft Studios (“DuskSoft,” “we,” “us,” or “our”), is responsible for the personal information described in this Privacy Policy.
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use:
- dusksoftstudios.com and other websites that link to this Privacy Policy;
- Absolute Territory: Duels of the Gods, including its Steam Playtest, game client, accounts, multiplayer features, and later releases;
- playtest applications, surveys, support, feedback, and other related services or communications.
We refer to these collectively as the “Services.” This Privacy Policy does not apply to a third-party service that has its own privacy policy, such as Steam, even when that service is used with our Services.
This Privacy Policy is a notice about our information practices; it is not a request for consent. Some processing is necessary to provide an online account or operate the Game. If you do not provide information that is required for a feature, that feature may not be available.
1. Summary
- We collect information needed to create and secure accounts, operate online matches and progression, support players, and maintain the Services.
- If you connect or use Steam, we receive limited Steam account, ownership, entitlement, and transaction information. Valve processes your Steam account and payment credentials under Valve’s own privacy policy.
- We do not sell personal information or use it for targeted advertising. Send privacy questions or rights requests to support@dusksoftstudios.com.
2. Personal Information We Collect
The information we collect depends on how you interact with the Services and which features are available in your build or region. An example below does not mean that every build collects every item.
2.1 Information You Provide
Account and profile information. We may collect your account ID, username, display name, email address, age or age-confirmation status where requested, account preferences, and authentication information. If we offer email-and-password login, we store a one-way password hash rather than your plaintext password.
Playtest applications and surveys. If you apply for a playtest or answer a survey, we may collect your preferred name, email address, age confirmation, platform, region or time zone, availability, relevant game experience, optional Discord handle, Steam display name, reasons for your interest, and any additional information you choose to provide.
Support, reports, and feedback. We collect information you send in support requests, bug reports, moderation or fair-play reports, feedback, emails, forms, and other communications. This may include screenshots, diagnostic files, transaction references, account details, and any other information you choose to include.
Purchase-related information. If purchases are offered, we may receive or maintain transaction identifiers, the item or virtual currency purchased, amount, currency, time, entitlement status, and information about refunds, reversals, or chargebacks. Steam or another payment platform processes your payment credentials. We do not receive or store the full payment-card number you provide directly to that platform.
2.2 Information From Steam and Other Platforms
When you access the Game through Steam or link a Steam account, we may receive information made available by Valve, such as your Steam ID, Steam display name and profile information, authentication result, ownership or entitlement status, app or build access, and transaction or refund status. We use this information to authenticate you, link accounts, verify access, deliver purchases, and support platform features.
Valve independently processes information for Steam under the Valve Privacy Policy. Your Steam use is also governed by Valve’s terms.
2.3 Gameplay and Progression Information
We collect records needed to operate and preserve the Game, which may include:
- collections, cards, decks, cosmetics, virtual currency balances such as Belief, grants, rewards, and other virtual content;
- experience points, account level, progression, unlocks, achievements, quests, and event participation;
- match actions, match results, opponents, matchmaking state, ratings, rankings, tournament participation, and competitive records;
- disconnects, reconnects, forfeits, abandoned matches, and related service events;
- rule-enforcement history, restrictions, suspensions, and information used to investigate cheating, fraud, abuse, or exploitation.
Because the Game is an online multiplayer service, some records necessarily relate to more than one player. For example, a match record may identify both participants and the result.
2.4 Technical, Device, and Service Information
When you use the Services, we and our service providers may automatically collect:
- IP address and approximate location derived from the IP address, such as country or region;
- device, operating system, browser, language, and basic hardware or software information;
- game client version, build, release channel, platform, session identifiers, and timestamps;
- authentication, API, database, network, server, and security logs;
- errors, crashes, failed requests, latency, performance, reconnect events, and other diagnostic information;
- signals associated with suspected fraud, cheating, abuse, unauthorized access, or attacks on the Services.
We use this information to deliver, secure, troubleshoot, and improve the Services. We do not collect precise GPS location through the Game.
2.5 Website Forms, Hosting, Cookies, and Browser Storage
Our website does not use DuskSoft game accounts. However, the website and its providers process information in the following ways:
- Forms. Form submissions may be processed by Formspree and delivered to us. The form itself identifies required and optional fields.
- Website hosting. The website is hosted through GitHub Pages. GitHub may log a visitor’s IP address and process browser, device, page, referral, timestamp, access-log, and security information.
- Cookie preference. The website stores a cookie named
dss_cookie_preferencesfor up to one year to remember your consent version, consent status, optional-storage choice, and update time. - Local preference record. The website stores the same preference in local storage under
dss-cookie-preferences-v1until you clear browser storage. - Optional daily-pull history. If you allow optional browser storage, the website may store the last pull date and locally collected card history under
ww-daily-pull. This information remains in that browser until you clear it. It is not an in-game collection, account inventory, or server-backed entitlement.
You can change your optional-storage choice through Cookie Preferences in the website footer. Rejecting optional storage does not prevent ordinary use of the website, but optional history or preferences may not persist between visits.
For more information about provider practices, see the GitHub Privacy Statement and Formspree Privacy Policy.
2.6 Information From Other Sources
We may receive information from other players when a match record involves you or when they submit a report. We may also receive information from service providers that help us prevent abuse, operate infrastructure, process forms, deliver communications, or investigate technical and security issues. We combine information from these sources only as reasonably necessary for the purposes described in this Privacy Policy.
3. How We Use Personal Information
We use personal information to:
- create, authenticate, link, maintain, recover, and secure accounts;
- verify platform ownership, licenses, playtest access, and entitlements;
- operate online play, matchmaking, reconnects, progression, collections, events, tournaments, rankings, and rewards;
- process and deliver purchases, reconcile entitlements, and address refunds, reversals, chargebacks, and transaction disputes;
- provide support, respond to questions, review reports, and communicate service or account information;
- select and manage playtest participants and evaluate playtest feedback;
- diagnose errors, crashes, outages, compatibility problems, and network or performance issues;
- improve stability, usability, accessibility, security, game balance, and other aspects of the Services;
- detect, investigate, prevent, and respond to cheating, fraud, abuse, unauthorized access, exploits, and attacks;
- enforce our EULA, event rules, fair-play rules, and other applicable terms;
- maintain business, transaction, tax, accounting, audit, dispute, and legal records;
- comply with law and valid legal process, protect rights and safety, and establish, exercise, or defend legal claims;
- generate statistics or research using aggregated or de-identified information that is not reasonably capable of identifying an individual.
4. Legal Bases for EEA, UK, and Similar Jurisdictions
If the law where you live requires a legal basis for processing, we rely on the following bases as applicable:
| Purpose | Legal basis |
|---|---|
| Creating accounts; authenticating users; providing online matches, progression, purchases, support, and other requested features | Performance of our agreement with you or steps you request before entering that agreement |
| Securing the Services; preventing cheating, fraud, abuse, and attacks; preserving match integrity; troubleshooting; improving the Services; maintaining ordinary business records | Our legitimate interests in providing a safe, reliable, fair, and sustainable service, balanced against your rights |
| Tax, accounting, consumer-protection, sanctions, law-enforcement, and other legal requirements | Compliance with a legal obligation |
| Optional website storage, optional communications, or other processing for which we specifically ask permission | Consent, which you may withdraw for future processing |
| Protecting a person in an emergency where another basis is unavailable | Protection of vital interests, where applicable |
Where we rely on legitimate interests, you may have the right to object. Where we rely on consent, withdrawing it does not affect processing that already occurred lawfully.
5. How We Disclose Personal Information
We may disclose personal information to the following recipients for the purposes described in this Privacy Policy:
Valve and other platforms. We exchange information with Valve or another distribution, authentication, or payment platform to authenticate accounts, verify ownership and access, operate platform features, deliver purchases, reconcile entitlements, and address refunds or fraud.
Infrastructure and technology providers. Providers may host our application, API, databases, networking, backups, or other technical systems. We use DigitalOcean for some game infrastructure. Provider processing is governed by applicable contracts and privacy terms, including the DigitalOcean Privacy Policy.
Website and form providers. GitHub Pages hosts the website, and Formspree processes website form submissions.
Communications and support providers. Email, customer-support, error-reporting, or communication providers may process information needed to deliver those services if and when we use them.
Professional advisers. Lawyers, accountants, auditors, insurers, and other professional advisers may receive information when reasonably necessary to provide their services or protect legal rights.
Authorities and protective disclosures. We may disclose information if we reasonably believe disclosure is required by law, valid legal process, or a lawful government request, or is necessary to protect players, DuskSoft, another person, or the security and integrity of the Services.
Business transactions. Information may be disclosed in connection with a proposed or completed financing, merger, acquisition, reorganization, sale of assets, or similar transaction, subject to applicable law and appropriate confidentiality protections.
We may disclose aggregated or de-identified information that is not reasonably capable of identifying you. We require service providers that process personal information for us to use it only for authorized services and to protect it appropriately, subject to applicable law and our agreements with them.
6. Purchases and Virtual Content
If purchases are offered through Steam, Valve processes the payment method and the transaction under Valve’s terms and privacy policy. DuskSoft receives only the information reasonably needed to confirm the transaction, provide the purchased license or virtual content, maintain account entitlements, provide support, prevent fraud, and address refunds or disputes.
Virtual currency, cards, collections, rewards, and other virtual content are account records. If an account is deleted, access to associated virtual content may be permanently lost, subject to applicable law and any records we must retain.
7. Sale, Sharing, Targeted Advertising, and Sensitive Information
We do not sell personal information. We do not share personal information for cross-context behavioral advertising and do not process personal information for targeted advertising.
We do not use sensitive personal information to infer characteristics about players. We do not knowingly collect biometric identifiers, health information, precise GPS location, or the contents of private communications through the Game.
If these practices change, we will update this Privacy Policy and provide any consent or opt-out controls required by law before the new practice begins.
8. Automated Systems
The Services may use automated rules to support matchmaking, calculate rankings or rewards, identify technical anomalies, and flag suspected cheating, fraud, abuse, or security threats. These systems may affect gameplay, access, or a provisional investigation. Where appropriate, significant account-enforcement decisions may be reviewed by authorized personnel.
We do not use automated decision-making intended to produce legal or similarly significant effects about you. If that changes, we will provide any additional notice and rights required by law.
9. Data Retention
We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, including to provide the Services, preserve security and fair play, resolve disputes, comply with law, and enforce agreements. The exact period depends on the category and context:
- Account, progression, and entitlement records are generally kept while the account is active. After closure or a valid deletion request, we delete or de-identify information that is no longer needed, subject to backup cycles and the exceptions below.
- Match, tournament, ranking, and enforcement records may be retained after account closure when needed to preserve records involving other players, competitive integrity, security, dispute history, or legal claims. Where practical, we may remove or replace direct account identifiers.
- Authentication, API, diagnostic, anti-abuse, and security logs are retained for a limited period based on operational, security, investigation, and dispute needs. A record may be kept longer if connected to an incident, enforcement action, legal hold, or unresolved claim.
- Transaction, refund, chargeback, tax, and accounting records are retained for the periods required by applicable financial, tax, consumer-protection, and recordkeeping laws.
- Support requests, bug reports, and feedback are retained until the matter is resolved and for a reasonable period afterward to address repeat issues, improve the Services, preserve an audit trail, or handle disputes.
- Playtest applications and survey responses are retained through participant selection and the relevant playtest, then for a reasonable period needed for follow-up, development records, future invitations where permitted, disputes, or legal compliance.
- Website cookie and browser-storage records remain for the periods described in Section 2.5 or until you clear them.
- Backups are overwritten on our normal backup cycle unless preservation is required for security, disaster recovery, a legal hold, or another lawful reason.
- Aggregated or de-identified information may be retained for longer because it is not reasonably capable of identifying you.
We may retain a limited record of a privacy request and our response to demonstrate compliance and prevent repeated unauthorized requests.
10. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. Depending on the system, these may include access controls, authentication protections, encrypted transmission, monitoring, backups, and one-way password hashing.
No method of transmission, software, or storage is completely secure. You are responsible for protecting your device, Steam account, email account, and login credentials. Contact us promptly if you believe your DuskSoft account or information has been compromised.
11. International Processing and Transfers
DuskSoft is based in the United States. We and our providers may process personal information in the United States and other countries where we or they operate. Those countries may have privacy laws that differ from the laws where you live.
Where required, we use a recognized transfer mechanism or safeguard, such as an adequacy decision, contractual protections, or Standard Contractual Clauses. You may contact us for more information about safeguards relevant to your personal information.
12. Your Rights and Choices
Depending on where you live and subject to legal exceptions, you may have the right to:
- know or confirm whether we process your personal information;
- access personal information we maintain about you;
- correct inaccurate personal information;
- delete personal information;
- receive a portable copy of certain personal information;
- restrict or object to certain processing;
- withdraw consent for future processing;
- opt out of sale, targeted advertising, or certain profiling where applicable;
- appeal our refusal of a privacy request where applicable;
- lodge a complaint with a data-protection or supervisory authority.
We do not discriminate against you for exercising an applicable privacy right.
12.1 How to Submit a Request
Email support@dusksoftstudios.com with the subject line “Privacy Request.” Describe your request and identify the relevant account, email address, and linked Steam account, if applicable. Do not send your password, full payment-card number, or unnecessary identity documents by email.
We may ask for information reasonably necessary to verify your identity and authority before acting. If we cannot verify a request, or an exception applies, we may deny or limit it and explain why when required. An authorized agent may submit a request where permitted by law, but we may require proof of authority and may verify the request directly with you.
To appeal a denied request where applicable, reply to our decision with the subject line “Privacy Appeal” and explain why you believe the decision should be reconsidered.
12.2 Account Deletion
You may request deletion through an in-game account-deletion feature if one is available or by emailing us as described above. Deletion may permanently remove access to the account, progression, virtual content, and purchase-linked entitlements.
We may retain or de-identify limited information when reasonably necessary for transactions, refunds, fraud prevention, security, competitive integrity, records involving other players, legal compliance, disputes, or enforcement. Information in backups may remain until the relevant backup is overwritten, unless a longer hold is legally required.
12.3 Cookie and Communication Choices
You can manage optional website storage through Cookie Preferences and can clear cookies or local storage through your browser. You may unsubscribe from optional promotional emails through the message’s unsubscribe method or by contacting us. We may still send non-promotional account, security, transaction, legal, or service messages when necessary.
13. Additional Information for U.S. Residents
U.S. state privacy laws may require additional disclosures and rights for residents of certain states when a business meets the law’s applicability thresholds.
The categories of personal information we may collect are described in Section 2. They may correspond to identifiers, customer-record information, commercial information, internet or network activity, approximate location, gameplay or service activity, and communications or submissions. We collect these categories from the sources described in Section 2, use them for the purposes in Section 3, and disclose them to the recipients described in Section 5.
We do not sell personal information or share it for cross-context behavioral advertising. We do not knowingly sell or share the personal information of anyone under 16. We do not offer financial incentives in exchange for personal information.
Applicable rights may include access, correction, deletion, portability, and the right to opt out of sale, targeted advertising, certain sharing, or certain profiling. Because we do not currently engage in sale or targeted advertising, no opt-out is necessary for those practices at this time. You may submit another applicable request using Section 12.1.
14. EEA and UK Information
For EEA and UK data-protection law, DUSKSOFT STUDIOS LLC is the controller of personal information covered by this Privacy Policy. The purposes and legal bases are described in Sections 3 and 4, recipients in Section 5, retention in Section 9, international transfers in Section 11, and individual rights in Section 12.
You may complain to the data-protection authority where you live, work, or believe a violation occurred. We encourage you to contact us first so we can try to resolve the concern.
15. Children’s Privacy and Age Requirements
The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from a child under 13. If we learn that we collected such information without legally sufficient parental permission, we will take reasonable steps to delete it.
A specific Service or playtest may have a higher age requirement. The current external playtest application requires applicants to confirm that they are at least 18. In other contexts, users under the age of legal majority where they live must have a parent or legal guardian review and accept applicable terms and supervise their use.
If you believe a child under 13 provided personal information to us, contact support@dusksoftstudios.com and include enough information for us to locate the record. Do not send unnecessary information about the child.
16. Third-Party Services and Links
The Services may contain links to or integrations with third-party services, including Steam, GitHub, Formspree, Discord, and social-media or storefront pages. Their handling of personal information is governed by their own policies, not this Privacy Policy. We encourage you to review those policies before providing information to a third party.
17. Changes to This Privacy Policy
We may update this Privacy Policy as the Services, providers, or legal requirements change. We will post the revised policy on our Privacy Policy page and update the effective or last-updated date.
If a change materially affects how we use personal information, we will provide additional notice when required, such as through the Game, account email, website, Steam announcement, or a renewed consent request. We may retain prior versions for reference.
